TERMS AND CONDITIONS

In the Terms and Conditions the following definitions apply: ”Company” means Equicise Limited. ”Client” means any person that has completed and submitted the Online Profile (the “Online Profile”) at the Equicise On-Line Booking Site, and which Online Profile has been accepted by the Company. ”Facilities” means any one of the Equicise Limited rooms and other facilities at Equicise Limited 24 a/b High Street, Wimbledon, SW19 5DX. ”Terms and Conditions” means these Terms and Conditions.

References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine gender.

The Terms and Conditions are incorporated into the Online Profile

The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of its affairs and the conduct of Clients. Any such changes will be notified to Clients and, until revoked, are and will be binding on Clients.

The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.

EQUICISE CLENTS

Subject to these Terms and Conditions, when a person has completed the Online Profile he will become a Client of the Company.

Acceptance of a person as a Client is in the absolute discretion of the Company.

The Company reserves the right to expel from its Facilities, suspend for a specific period or refuse to renew the membership of any Client whose conduct is or may, in the Company’s reasonable opinion, be injurious to the character of the Company or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Clients of the Company. Any Client so expelled will forthwith cease to be a Client of the Company and will not be entitled to any refund for any period during which his membership is suspended.

Clients must be 16 or over to enrol in Equicise Studio sessions.  Children aged 6 years and older may enrol only in Simulator Private Lessons and parent or guardian may be required to be present at the Company’s discretion.

SESSION TIMES

Details of session times may vary from time to time. Session times will be published by the Company and will be available either at the Facilities or at Equicise On-Line Booking Site.

PAYMENT TERMS

Details of session prices and gift certificate prices are available either at Equicise On-Line Booking Site, or directly from the Company and will be such prices as determined by the Company from time to time.

A Client may not attend any session without first booking and paying for the relevant session.

Payments for sessions and gift certificates in any amount are non-refundable unless otherwise stated in the Terms and Conditions.

 

BOOKINGS AND CANCELLATIONS

A Client may only book or reschedule sessions for themselves via their personal booking facility Equicise On-Line Booking Site.

Cancellation Policy: Reservations for sessions can be cancelled online for no charge up to 24 hours prior to the beginning of the session. 24 hours’ notice is required for cancellation of single sessions.

Sessions are booked on a first-come first-served basis. If a Client is added to a session from a waiting list, he must confirm his reservation 2 hours prior to the start of the session. When a client is added to a session from the waiting list he will receive an automatic Wait list Notification email. Once he receives the notification he must confirm his attendance and make payment online at Equicise On-Line Booking Site,  Once a session is confirmed Clients will be held to the cancellation policy as described above.

FITNESS AND HEALTH

By agreeing to these Terms and Conditions Clients hereby confirm that they have no health problems (including without limitation cardiac irregularities; spinal, bone, joint, tendon or ligament injuries; spells of dizziness; asthma (or other breathing difficulty); diabetes, epilepsy or any allergy) which may affect their participation in any sessions at EQUICISE.

It is a Client’s sole responsibility to notify the Company before attending any session of any circumstances affecting his health which may be exacerbated through continued use of the Facilities and/or which may have arisen or worsened since his last session at the Facilities (if any).

Clients are advised not to undertake strenuous physical activity without first seeking medical advice if they have concerns over their physical condition and wellbeing. Clients with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Client should consult his doctor.

The Company reserves the right to refuse access to any Client if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of the Facilities.

Clients are required to follow the instructions of the instructor at all times.

USE OF FACILITIES

A Client is entitled to use the Company’s facilities provided always that the Company may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Company.

Children under the age of 16 may not use the Equicise Studio and attend classes

PERSONAL BELONGINGS

Personal belongings are brought onto the Company’s premises and those of Wimbledon Village Stables at the Client’s own risk and the Company does not accept liability for any loss or damage whatsoever to such items.

DRESS

Clients are requested to wear a form of dress appropriate to the practice of fitness activities and Equicise Limited recommends that Clients attending fitness sessions wear stretch pants or shorts and a T-shirt or sports top. Clients should attend sessions with socks that cover the entire foot and clean trainers if using the Equipods.  Clients riding the horse simulator should wear comfortable, stretchy trousers (breeches or jodhpurs ideally) and riding footwear. Please note that boots should not have zips on the inside. If Clients usually wear gloves when riding they may like to bring them. Riding hats are optional although some riders find it helpful to get used to weight of the hat on their head.

SAFETY & HYGIENE

In the interests of safety and hygiene, no crockery, glass or food are permitted in all areas of the Facilities unless it has been pre agreed in the case of a Group Lesson. Only closed containers of water are permitted in the Facilities. Dogs are permitted in the Equicise Ride Room providing they remain in the comfy dog pen.

Notwithstanding paragraph 10 above, Clients must not walk around the exercise rooms barefoot if they have verucas or similar foot complaints.

If a session is taking place outside of Wimbledon Village Stable’s opening hours Clients are requested to make their way straight to the relevant Equicise facility and not disturb the horses in any way.   Fire exits, which are clearly marked, are there in the interests of safety and Clients must not interfere with these exits for any reason. In the event of a fire, Clients are asked to make their way to the nearest available exit.

Smoking is forbidden in the Facilities and in all areas of the Wimbledon Village Stable Yard.

GENERAL

Clients are required to give written notice to the Company of any change of address. Failing such notice, all communications will be assumed to have been received by the Client within five days of mailing to the last address notified to the Company.

The Company reserves the right to refuse admission to its Facilities.

A person who is not a party to the Online Profile Process has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Online Profile Process.

The Company may, if a Client so wishes, communicate with the Client by electronic mail (“email”). By providing an email address to the Company the Client consents to receiving email communications from the Company, including notices pursuant to the Terms and Conditions. The Client also accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Client by email.

Clients must at all times observe the Company’s guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Facilities may issue to ensure the smooth operation of the Facilities for the convenience of all Clients.

Any marketing, educational or other materials of any nature whatsoever produced by the Company in connection with the Facilities and which are made available to Clients at the Studio will at all times remain the property of the Company and will be subject to the Company’s copyright.

There is no parking at Wimbledon Village Stables, or in the car park behind Andrew Scott Robertson, or in the passageway beside the Dog & Fox. There is pay and display parking all around Wimbledon Village and the Facilities are easily accessible by public transport.

PURCHASE POLICY

EQUICISE PRIVATE SIMULATOR single class expires 1 month from purchase

EQUICISE PRIVATE LESSON 3 pack expires 3 months from date of first lesson

EQUICISE PRIVATE LESSON 5 class pack expires 5 months from date of first lesson

Introductory Studio class  and Introductory Simulator class expires 14 days from purchase. One per person.

Single Studio Class expires 1 month from date of first lesson

EQUICISE Studio 10 class packs have 3 month expiry from date of first lesson

EQUICISE Studio 20 class packs have 6 month expiry from date of first lesson

EQUICISE SIMULATOR MEMBERSHIP

Entitles you to one 30 minute Private Simulator Lesson and three bookable 20 minute MEMBERS’ Practice Sessions each month.  It also includes one ‘Hop On’  Simulator Sessions per day and use of the Equicise Studio and equipment for personal practice when available. Additional 30 minute Private Simulator Lessons can be purchased at a special reduced MEMBERS’ price. (see booking site)

EQUICISE SIMULATOR MEMBERSHIP is allocated to an individual and rides cannot be transferred to any other person.  All bookings for 30 minute Private Simulator Lessons and 20 minute MEMBERS’ Practice sessions are made on-line.   ‘Hop On’ sessions, which can run for up to 10 minutes between 07.30 and 16.00, Tuesday-Sunday, are booked on the day at the Stables, subject to availability, maximum of one per day. The EQUICISE Studio and its equipment is available for MEMBERS to use for personal fitness practice when available Tuesday-Sunday between 8.30 and 3.30. Unused sessions at the end of the month cannot be accrued, carried forward or refunded.

EQUICISE SIMULATOR MEMBERS must cancel reservations for booked 30 minute private sessions or 20 minute MEMBERS’ Practice sessions on-line at least 24 hours in advance of the scheduled time. Failing to cancel in time or failing to turn up for the Simulator booked ride will result in the session being charged as if it had been taken.

EQUICISE SIMULATOR MEMBERSHIP TERMS

THIS IS A MONTHLY MEMBERSHIP. YOU WILL BE CHARGED EVERY MONTH UNTIL YOU CANCEL, IN ACCORDANCE WITH THE FOLLOWING TERMS.

I understand and agree that every month I will be charged £100.00 using my saved credit/debit card for this MEMBERSHIP package. I will be charged this amount every calendar month until I cancel, in accordance with the cancellation policy.

EQUICISE SIMULATOR MEMBERSHIP entitles me to attend one 30 minute Private Simulator Lesson and three 20 minute bookable MEMBERS’ Practice Sessions per calendar month. These can be taken at any time during the calendar month, subject to booking and availability.  It also includes one ‘Hop On’ sessions every month, also subject to availability. ‘Hop On’ sessions last up to 10 minutes are not bookable in advance and are available only between 7.30 am and 4.00 pm, Tuesday-Sunday, maximum of one per day. Unused sessions at the end of the month cannot be accrued, carried forward or refunded.

I understand that from time to time EQUICISE may offer workshops or other Classes that are completely separate from my MEMBERSHIP, and if I wish to attend I will have to pay separately for them.

I understand that I will be notified if my payment fails to be authorised for any reason, and that a £10 late fee will apply if I do not provide a valid credit or debit card within 10 calendar days of the original rejection date.

EQUICISE SIMULATOR MEMBERSHIP CANCELLATION POLICY:

I understand and agree that this is a monthly agreement and, except as otherwise noted, will remain active unless I cancel it by giving exactly 30 days written/email notice to EQUICISE prior to my next billing date; otherwise the next monthly payment will be processed as normal.

I understand that the EQUICISE SIMULATOR MEMBERSHIP runs for a minimum three month period.  I may request cancellation of my MEMBERSHIP after the first eight weeks, but will be charged for the remaining four weeks per the 30 day notice requirement.

EQUICISE reserves the right to cancel my MEMBERSHIP at any time.

EQUICISE reserves the right to alter MEMBERSHIP prices and services with three month notice period will be given for any changes.

LATE CANCELLATION OF PRIVATE SIMULATOR LESSONS AND MEMBERS’ PRACTICE SESSIONS:

I understand that If I book a Private Simulator Lesson or MEMBERS’ Practice Session and my schedule changes, I must cancel my reservation according to the EQUICISE cancellation policy (24 hours in advance of my scheduled class).

If I do not cancel in time, each late cancellation will result in the Session being charged as if it had been attended.

EQUICISE FITNESS MEMBERSHIP

Entitles you each month to attend four 60 minute Studio Classes (Fitness, Yoga or Pilates) and use the EQUICISE Studio and equipment for personal practice sessions when available. Additional Studio Classes can be purchased at a special reduced MEMBERS’ price (SEE BOOKING SITE)

EQUICISE FITNESS MEMBERSHIP is allocated to an individual cannot be transferred to any other person.  All bookings for sessions are made on-line. The EQUICISE Studio and its equipment is available for MEMBERS to use for personal fitness practice when available Tuesday Sunday between 08.30 and 15.30.

EQUICISE FITNESS MEMBERS must cancel reservations for booked sessions on-line at least 24  hours in advance of the scheduled time. Failing to cancel in time or failing to turn up for the class will result in the session being charged as if it had been taken. Unused sessions at the end of the month cannot be accrued, carried forward or refunded.

EQUICISE FITNESS MEMBERSHIP TERMS

THIS IS A MONTHLY MEMBERSHIP. YOU WILL BE CHARGED EVERY MONTH UNTIL YOU CANCEL, IN ACCORDANCE WITH THE FOLLOWING TERMS.

I understand and agree that every month I will be charged £68.00 using my saved credit/debit card for this MEMBERSHIP package. I will be charged this amount every calendar month until I cancel, in accordance with the cancellation policy.

EQUICISE FITNESS MEMBERSHIP entitles me to attend four 60 minute Studio Classes (Fitness, Yoga or Pilates) every month.  These can be taken at any time during the calendar month, subject to booking and availability. Unused sessions at the end of the month cannot be accrued, carried forward or refunded.

I understand that from time to time EQUICISE may offer workshops or other Classes that are completely separate from my MEMBERSHIP, and if I wish to attend I will have to pay separately for them.

I understand that I will be notified if my payment fails to be authorised for any reason, and that a £10 late fee will apply if I do not provide a valid credit or debit card within 10 calendar days of the original rejection date.

EQUICISE FULL MEMBERSHIP

Entitles you to one 30 minute Private Simulator Lesson, four bookable 20 minute Members’ Practice Simulator Sessions, four 60 minute Studio Classes (Fitness, Yoga or Pilates) each month.  It also includes one ‘Hop On’  Simulator Sessions per day and use of the Equicise Studio and equipment for personal practice when available. Additional 30 minute Private Simulator Lessons and  60 minute Studio Classes can be purchased at a special reduced MEMBERS’ price. (see booking site)

EQUICISE FULL MEMBERSHIP is allocated to an individual and Simulator Rides and Studio Classes cannot be transferred to any other person.  All bookings for 30 minute Private Simulator Lessons, 60 minute Studio Classes and 20 minute MEMBERS’ Practice sessions are made on-line.   ‘Hop On’ sessions, which can run for up to 10 minutes between 07.30 and 16.00, Tuesday-Sunday, are booked on the day at the Stables, subject to availability, maximum of one per day. LIMITATION OF LIABILITY

The information available on or through this website, and the Services supplied via or in connection with this Site or at the Equicise Limited Facilities do not constitute medical advice and it is  the Client’s responsibility to determine, through obtaining appropriate medical advice, that he is fit and well and that such contents and services are suitable for him. It is not the Company’s responsibility to do so. Before commencing any exercise regime, the Client should consult his doctor. It is also vital that the Client supplies the Company with correct information about himself. The Company cannot be liable for any incorrect information supplied by the Client. The Company attempts  to ensure that all information contained on this website (and provided by the Company to the Client as part of any Services or Products) is correct, but, subject to the paragraph below, the Company does not accept any liability for any error or omission and excludes all liability for any action a Client (his legal representatives, heirs) may take or loss or injury a Client may suffer (direct or indirect including loss of pay, profit, opportunity or time, pain and suffering, any indirect, consequential or special loss, however arising) as a result of relying on any information on this web site or provided through any Service supplied by the Company to you. Clients and their legal representatives and their heirs release waive, discharge and covenant, not to sue Equicise Limited and its instructors for any injury or death caused by their negligence or other acts. Any Client questions or complaints should be addressed in writing to the Company at email equiciseltd@gmail.com.

The Company cannot be held responsible for any particular session, instructor and/or item of equipment not being available for whatever reason. The Company reserves the right to make alterations to the sessions, instructors and/or equipment, as well as to those ancillary facilities provided to Clients, without notice and in its absolute discretion and the Company will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.

It is the Client’s responsibility to ensure that he is capable of undergoing a routine of exercises provided by any programme which he follows or class which he attends. Clients accept the risk of injury from performing exercises and using specialist equipment and are advised to consult their doctor prior to beginning any session. Advice provided by the Company’s instructors at no time constitutes medical advice in substitute for advice provided by a medical professional.

The Company accepts no liability for loss or damage to property of Clients or for injury to Clients on the  Company’s premises or those of Wimbledon Village Stables except insofar as such loss, damage or injury is by law incapable of exclusion.

In consideration of his participation in the activities and programmes of the Company and the use of facilities and equipment owned and/or under the control of the Company the Client hereby waive and release the Company from any and all responsibility or liability for injuries or damages resulting from his participation in any of the Company’s activities or use of the Company’s equipment or facilities save in respect of death or personal injury caused by the negligent act or omission of the Company.
